Patriot Act Disclosure
To help the government fight the funding of terrorism and money laundering activities, Federal Law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account.
What this means for you: When you open and account, we will ask you for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.
Rate Information
The Dividend Rate and Annual Percentage Yield on your accounts are set forth on the Rates and Yields Page. The Dividend Rate and Annual Percentage Yield are subject to change.
Regulation "D"
This regulation was implemented by the Board of Governors of the Federal Reserve System, whose job is to ensure that financial institutions maintain adequate reserves for the funds they have on deposit. It limits the number of pre-authorized, automatic or phone transactions you make each month on a deposit account to a maximum of six. During any month, you may not make more than six transfers from your Share Savings, Club Accounts, Money Market Account, or Sub-Share Accounts to another Credit Union account of yours, or to a third party by means of a pre-authorized or automatic transfer or telephonic order or instruction. No more than three of the six transfers may be made by check, draft, debit card, if applicable, or similar order to a third party.
National Credit Union Share Insurance Fund
Member accounts in this Credit Union are federally insured by the National Credit Union Share Insurance Fund.
The Federal Equal Credit Opportunity Act
The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. Overdraft (Courtesy Pay) Policy
- Basic Philosophy
It is the policy of our financial institution to comply with applicable laws and regulations, and to conduct business in a SAFE and SOUND manner. Insufficient balances may result from: A) Share draft payments, electronic funds transfer, or other withdrawal requests; B) Payments authorized by accountholder; C) Unpaid return of items deposited by the accountholder; D) Imposition of financial institution service charges; E) Deposit of items which according to the Credit Union's Funds Availability Policy, are treated as not yet "available" or finally paid. The Courtesy Pay Overdraft program provides a service to our members that will protect their financial standing, provides a measure of protection against human error, while imposing a fee at a fair and reasonable cost.
- Courtesy Pay Program
We are not obligated to pay any item presented for payment if the account does not contain sufficient collected funds. However, if the accountholder maintains the account in good standing, defined as A) Making regular deposits sufficient to cover transactions; B) Bringing the account to a positive balance at least once every thirty days or less; C) There are no legal orders outstanding, we may, at the Credit Union's sole discretion, pay their reasonable overdrafts as a non-contractual courtesy; and D) Has not incurred losses at the Credit Union (i.e., bankruptcy, etc). We may, at the Credit Union's sole discretion, pay reasonable overdrafts as a non-contractual courtesy. Generally, we will not pay an overdraft in total excess of $300 for Personal Share draft accounts. This limit includes our Non-Sufficient Funds and/or Courtesy Payment charge(s). We may refuse to pay an overdraft at any time, even though we may have previously paid the overdrafts. The accountholder will be notified by mail of any Non-Sufficient Funds items paid or returned that the account may have. However, we have no obligation to notify the accountholder before we pay or return an item. The amount of any overdrafts, plus our Non-Sufficient Funds and/or Courtesy Payment Charge(s) that the accountholder owes us are due and payable upon demand. If we pay an overdraft on an account with more than one (1) owner on the signature card, each owner, and/or agent where applicable, drawing/presenting the item, thereby creating the overdraft, are jointly and severally liable for such overdrafts plus our Non-Sufficient Funds and/or Courtesy Payment charge(s). If the accountholder receives a direct deposit of their monthly Social Security payment into their checking account and does not want Courtesy Pay eligibility, they must advise us to stop us from paying overdrafts with these funds.
- Limitations
We may limit the number of accounts eligible for Courtesy Payment to one account per household. Additionally, we reserve the right to not approve any overdrafts against any account until we can verify that the account is being maintained in good standing, as defined above.
- Fees
Whether we pay or return a Non-Sufficient Funds item, a per-item fee will be charged to the account as a Non-Sufficient Funds or Courtesy Payment charge, as set forth in our fees schedule.
- Disclaimer
The financial institution's Courtesy Payment plan is a non-contractual courtesy and is discretionary. It is not an obligation of the Credit Union and the Credit Union may refuse to provide the courtesy on any share draft account at any time and from time to time. The accountholder does not have a contractual right to Courtesy Payment and courtesy payment is not guaranteed by the Courtesy Payment plan.

Agreement and Initial Disclosures
- Definitions - The following definitions apply in this Agreement.
Account(s) refers to your checking, savings, or money market account you have with DUFCU, some of which may not be eligible for electronic transfers and bill payments using the Service.
DUFCU refers to Duke University Federal Credit Union where your Accounts may be located.
DUFCU Internet Account Access means the Internet application through which you may access the Service.
Business Day(s) means Monday through Friday, except Federal Reserve Bank holidays.
Payee refers to any business, merchant, or professional with a valid U.S. address that generates a bill or invoice for services, or services provided on your behalf, or any individual.
Payee Account refers to account to which the Payee will credit your payment.
Payee Information refers to information about a Payee that is used to properly direct payment to the Payee and permit the Payee to identify the correct Payee Account.
Payment Date refers to the date on which you want your payment to be sent to the Payee.
Service(s) refers to collectively, any or all of DUFCU Internet Account Services, which allows you to access Account and transaction information, transfer funds, and pay bills on a personal computer through DUFCU Online.
Transaction Date refers to the date on which we will process your scheduled bill payment, i.e., the date on which funds are withdrawn from your account for a scheduled Bill Payment.

Applicability - This Agreement and Initial Disclosures (the "Agreement") governs your use of the Service. By subscribing to the Service or using the Service, you agree to the terms of this Agreement. Please read this Agreement carefully and in its entirety. We suggest that you print a copy of this Agreement.

The Service - You may use a personal computer ("PC") to electronically direct us to make payments from your Account(s) to Payees whom you have selected in advance to receive payments. You may also access Account and transaction information and order transfers of funds among your eligible Account(s). Please make special note that not all DUFCU accounts are eligible for electronic transfers and bill payments using the Service. For instance, please continue to make payments to your related DUFCU accounts via the Internet Account Access transfer option on our website, instead of opting to use i-Bill Pay; and continue to make payments to your DUFCU Visa card via the Online Visa Access option on our website as opposed to using i-Bill Pay. You can arrange for i-Bill Pay to make payments to your unrelated DUFCU accounts. In order to clarify; a related DUFCU account is one in which you are a primary or joint holder, an unrelated DUFCU account is one in which you are neither the primary nor joint holder.

Bill Payments - You may make payments through the Service to any business, merchant, or professional with a valid address that generates a bill or invoice for services, or services provided on your behalf. We reserve the right to refuse to allow you to designate any particular Payee or class of Payee. You may also make payments through the Service to individuals, family, or friends for non-business purposes. Payments may be made only to Payees with a U.S. payment address. You may not make a payment of alimony, child support, taxes, or other governmental fees or court-ordered payments through the Service. Any user of this Service shall comply with all applicable laws and regulations including the laws and regulations administered by the U.S. Treasury Office of Foreign Assets Control (OFAC).

Member Responsibility - As a courtesy to you, our member, we may make an attempt to notify you, via email, if a payment fails or if any other problems arise. However, it is your primary responsibility to monitor your accounts to make sure that payments you elect to send via the i-Bill Pay service are processed accordingly. It is also your responsibility to provide us with a valid and current email address so that we may notify you electronically if issues arise through your use of the i-Bill Pay service. Please note that if your accounts with DUFCU are not current or in good standing, DUFCU reserves the right to suspend your i-Bill Pay service.

Your Payee List - You must provide sufficient information about each Payee as we may request from time to time, to properly direct a payment to that Payee and permit the Payee to identify the correct Account to credit with your payment. This information may include, among other things, the name, address, and phone number of the Payee and your Payee Account number. You agree that we may obtain information regarding your Payee Accounts in order to facilitate proper handling and crediting of your payments, and you authorize your Payees to release such information to us. You can enter your Payee Information directly on your PC. Additions, deletions, and modifications to Payee Information are entered directly on your PC and are communicated to us the next time you logon to the Service. Refer to Online Help for additional information about retrieving your account data.

Scheduling Bill Payments - To electronically schedule a payment with your PC, follow the simple instructions in the Online Help file. Payments may range in amounts up to $9,999.99, as long as funds are available. When you schedule a bill payment, you authorize us to withdraw the amount of your payment from your Account(s).

How Bill Payments are delivered - We may remit your payments by mailing your Payee a paper check or by electronic funds transfer. Payees who have a relationship established to receive electronic delivery of payments by us will receive your payment information by a computer link. Electronic payments are generally received and credited by most Payees within four (4) Business Days after we have processed the payment. We may also send payments by a draft drawn on an account we maintain for this purpose. We send all checks through the United States mail. Payments made with a paper draft are generally received and credited by most Payees within seven (7) Business Days after we have processed the payment. We are not responsible for postal delays or processing delays by the Payees. Occasionally, a Payee chooses not to participate in the Service, or may be unable to process payments in a timely manner. In such cases, we may decline to make future payments to these Payees; and we will make an attempt to notify you of this.

Processing/Delivery of Your Bill Payments - You may specify the Payment Date. We will withdraw money from your Account up to four (4) Business Days prior to the Payment Due Date if the payment will be sent electronically and up to seven (7) Business Days prior to the Payment Due Date if a check will be sent by mail. If the Transaction Date falls on a weekend or a Federal Reserve Holiday, your payment will be processed on the following Business Day. Although you may schedule bill payments by using the Service 24-hours a day, seven (7) days a week, payments can be processed only on Business Days, subject to system availability. We may refuse to process your payment if sufficient funds, including funds available under any overdraft plan, are not available in your Account(s) on the Transaction Date.

Future Bill Payments - It is our responsibility to make certain that payments made to merchants, vendors, etc., have an "active" status. As a courtesy to you, we may make an attempt to notify you of requests that can not be processed.

Recurring Bill Payments - You may schedule Payment Dates for a fixed amount on the same date every month (a "Recurring Payment"). If the specified Payment Date does not exist in a certain month, the Payment Date will be the first Business Day of the subsequent month. For example, if the specified Payment Date is for the 30th of each month, the Payment Date for the month of February will be the first available business day following the 28th of February. If the specified Payment Date falls on a day other than a Business Day in any month, your Payment Date will be the following Business Day. For example, if the specified Payment Date is the fifth (5th) of each month, and August 5th is a Saturday, the Payment Date for August will be on or before August 7th.

Guarantee for Bill Payments - DUFCU will reimburse you for any standard late payment fees or finance charges you are charged, up to a maximum of $50.00 per scheduled payment, as a result of our failure to deliver a payment made to a business by the scheduled Payment Date if you meet each of the following conditions:

You must properly schedule the Payment Date to be on or before the date the payment is due to the Payee. This means that you must schedule your payments before 5:00 p.m. Eastern Time, USA, on a Business Day at least seven (7) Business Days prior to the date the payment is due to the Payee. Mortgage payments differ from other Recurring Payments in the following manner: If your mortgage payment is due on the first of each month with a 15-day grace period, then you must schedule your mortgage payment to be processed on or before the third (3rd) calendar day of each month, or the payment guarantee will not apply.

You must provide us with the correct Payee name, address, due date, account information, and the correct payment amount.

Your Account(s), including any overdraft protection, must contain sufficient funds to complete the payment or transfer on the Transaction Date.

The payment must be made to a business.

The late payment fee or penalty, or the method of calculation, must be published by the Payee prior to the date the payment is due to the Payee.

Your PC hardware, software, telephone line, and Internet Service Provider, if applicable, must be functioning properly.

You must provide us with a copy of the statement identifying the late fee.
- Your accounts with DUFCU must be current and in good standing, or DUFCU may reserve the right to suspend your i-Bill Pay service.

Stopping or Modifying Bill Payments - You may use your PC to electronically change both the payment amount and the Payment Date of any scheduled Recurring Payments at any time that the word "PENDING" appears in the scheduled payments window. You may also stop any pending payment by calling 1.800.397.8840, or by writing DUFCU, 2200 West Main St, Suite L100, Durham, NC 27705, in time for us to receive your request seven (7) or more Business Days before the Transaction Date. If you call, we may also require you to put your request in writing and send it to us within 14 days after you call.

Liability for Failure to Stop Payment - If you order us to stop one of these Recurring Payments seven (7) Business Days or more before the Transaction Date, and we do not do so, we will be liable for damages up to the payment amount plus your standard fees or finance charges.

Reviewing Payments - For DUFCU Internet Account users, records of past and future scheduled payments are stored on the DUFCU host computer. Refer to Online Help for additional information about retrieving your payment history.

Incomplete Payments - If we remit your payment to a Payee by mailing your Payee a check, and the check has not been presented for payment within our payment cut-off period, we will investigate the status of the check. If the check has not been presented for payment by 90 days after the Transaction Date, we will place a stop payment order on the check and credit your account accordingly. Stopping a stale dated check will incur a Stop Payment Fee.

Documentation - All of your payments and funds transfers made through the Service will appear on your periodic account statement. The Payee Name, payment amount, and Transaction Date may be reflected for each payment made through the Service.

Fees - See Schedule A for Fees, attached hereto and incorporated herein by reference. Monthly fees may be changed with advance notice. Monthly fees for your use of the Service are in addition to any fees that you may incur on your Accounts. There may be additional fees charged against your Accounts if a transaction you initiate using the Service causes any of your Accounts to be overdrawn, exceed the maximum permissible number of transactions for the Accounts, or exceed any other qualifiers for the Accounts. Refer to the Truth in Savings/Fee Schedule, as amended from time to time, for these fees. You authorize DUFCU to deduct all applicable subscription, service, and use fees for the Service from your Checking Account. If we are unable to deduct all applicable fees from your Service Charge Account for any reason (such as, the Account has been closed or there are insufficient funds in the Account), you authorize DUFCU to deduct all applicable fees for the Service from any of your other Accounts.

Termination - You may terminate your use of the Service at any time by using the DUFCU Internet Account Access option found on our website, or by visiting your local DUFCU branch office, by calling 919.684.6704, or by writing to us at DUFCU 2200 West Main St, Suite L100, Durham, NC 27705. You must notify us at least ten (10) days prior to the date on which you wish to have your Service terminated. We may require that you put your request in writing. If you have scheduled payments with a Transaction Date within this ten-day period, you also must separately cancel those payments pursuant to the Stopping and Modifying Bill Payments Section of this Agreement. If we have not completed processing your termination request and you have not otherwise canceled a payment, you will be responsible for payments with Transaction Dates during the ten (10) days following our receipt of your written notice of termination.
Subject to applicable law, we may terminate your use of the Service, in whole or in part, at any time without notice if you do not pay any required fee when due, if you do not comply with the terms of this Agreement, or the agreements governing your Accounts, if your Account(s) or Service Charge Account is not maintained in good standing, and no other Account and Service Charge Account has been designated, or if we believe that you have handled your Account(s) or the Service in a fraudulent manner. We may also terminate your use of the Service for any other reason by giving you a 15-day notice. Termination will not affect your liability or obligation under this Agreement for transactions that we have processed on your behalf.

Service Hours - Internet Account Access services are available 24-hours a day, seven days a week, except during maintenance periods, for the scheduling, modification or review of payment orders, and for initiation of funds transfers and balance inquiries, however, bill payments can be processed only on Business Days.

Business Days - Our Business Days are Monday through Friday. DUFCU Holidays are not included.

Transfer Types and Limitations
- Account Access
You may use the Service to:

Transfer funds between your eligible Accounts whenever you request using the Internet Account Access transfer option. As stated above, please make special note that not all DUFCU accounts are eligible for electronic transfers and bill payments using the Service. For instance, please continue to make payments to your DUFCU accounts via the Internet Account Access transfer option on our website, instead of opting to use i-Bill Pay; and continue to make payments to your DUFCU Visa card via the Online Visa Access option on our website as opposed to using i-Bill Pay. You can arrange for i-Bill Pay to make payments to your unrelated DUFCU accounts. In order to clarify; a related DUFCU account is one in which you are a primary or joint holder, an unrelated DUFCU account is one in which you are neither the primary nor joint holder.;

Pay bills directly from your Account(s) in the amounts and on the days you request in accordance with the terms of this Agreement to merchants and individuals located in the U.S.;

Obtain Account balances through Internet Account Access;

Review the history of past transactions on your Accounts

- Limitations on Frequency of Transfers
The number of transfers between your eligible Accounts may be subject to the limitations that apply to the maximum number of automatic or recurring withdrawals from certain types of accounts. Refer to your Truth in Savings Agreement for details.
- Limitations on Dollar Amount of Transfers/Bill Payments
Each transfer between eligible Accounts may range in amounts up to $9,999.99. The maximum aggregate amount that can be transferred between eligible Accounts per day is unlimited. Each bill payment from an Account may range in amounts up to $9,999.99. The maximum aggregate bill payment amount that can be paid per day is unlimited.
- Limitations on Duplicate Payment Amount
The system will not process duplicate payment amounts to the same vendor with identical payment information on the same day.
- Account Access

Confidentiality - Subject to applicable law, we will disclose information to third parties about you and your Accounts or the transfers you make: (i) where it is necessary for completing transfers; or (ii) in order to verify the existence and condition of your Account for a third party, such as a credit bureau or merchant; or (iii) in order to comply with government agency or court orders; or if you give us permission; (iv) as stated in the DUFCU Privacy Notice and (v) as otherwise required or permitted by law or government regulation.

User ID and Password has been lost or stolen, or that someone to whom you
have granted authority to use your User ID and Password has exceeded such
authority, or that someone has transferred or may transfer money from your

Error Resolution Notice - In case of errors or questions about your Electronic Transfers telephone us at 919.684.6704 Or write: DUFCU Online Support, 2200 West Main St, Suite L100, Durham, NC 27705. Contact DUFCU as soon as you can if you think your statement or information regarding a transaction is wrong or you need more information about a transfer listed on the statement. We must hear from you no later than 60 days after we sent the first statement on which the problem or error appeared. When contacting DUFCU regarding an error resolution, please be prepared to communicate the following information:

Your name and social security number.

The error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.

The dollar amount of the suspected error.
If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) Business Days. We will tell you the results of our investigation within ten (10) Business Days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your Account within ten (10) Business Days for the amount you think is in error, so that you will have use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) Business Days, we may not credit your Account. If we decide that there was no error, we will send you a written explanation within ten (10) Business Days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

Electronic Messaging - DUFCU provides you with the ability to send and receive electronic messages to and from us. Please remember that we will not immediately receive an electronic message sent by you. If you need to contact us immediately, please see the Error Resolution Notice Section of this Agreement. No action will be made on any electronic message you send to us until we actually receive your message and have a reasonable opportunity to act on it. Electronic messaging CANNOT be used to notify us of lost or stolen User IDs or Passwords; nor can electronic messaging be used to notify us of unauthorized transactions. Notification of these occurrences must be done as specified in the Error Resolution Notice Section in this Agreement. From time to time, we may send important notices to you concerning your use of the Service by electronic messaging. In fact, electronic messaging is the primary means we utilize to inform you of any issues that may arise through your use of the i-Bill Pay service. It is your responsibility to provide us with a valid and current email address if you wish to receive any such notifications or alerts. The electronic messaging service may not be used to send or receive e-mail messages to or from the general public.

Limitation of Liability - Except as otherwise provided in this Agreement or by law, we are not responsible for any loss, injury, or damage whether direct, indirect, special or consequential, caused by the Service or the use thereof or arising in any way out of the installation, even if we have been advised of the possibility of such damages or losses. We are not responsible for any loss, damage, or injury resulting from an interruption in your electrical power or telephone; the disconnecting of your telephone line by your local telephone company or from deficiencies in your line quality, the failure or unavailability of Internet access; problems with Internet Service Providers, any defect or malfunction of your PC, modem, or telephone line. We are not responsible for any services relating to your PC other than those specified in this Agreement. DUFCU makes no warranty, express or implied, to you concerning the Service, equipment, browser or other services including, but not limited to any warranty of merchantability or fitness for particular purpose or non-infringement of third-party rights, unless disclaiming such warranty is prohibited by law.

Entire Agreement - This Agreement constitutes the complete and exclusive agreement related to the Service, Truth in Savings Agreement, and any other agreement or disclosure related to your Accounts. In the event of a conflict between this Agreement and any other agreement or disclosure related to your Accounts or any statement by our employees or agents, this Agreement shall control, only as to electronic fund transfers conducted by using the Service.

Waivers - No delay or omission by us in exercising any rights or remedies hereunder shall impair such right or remedy or be construed as a waiver of any such right or remedy. Any single or partial exercise of a right or remedy shall not preclude further exercise or the exercise of any other right or remedy. No waiver shall be valid unless in writing and signed by us.

Assignment - You may not assign this Agreement to any other party. We may assign this Agreement or delegate any or all of our rights and responsibilities under this Agreement to any third parties.

Governing Law - This Agreement shall be governed by and construed in accordance with the laws of North Carolina, without regard to that state's conflict of laws provisions.

Amendments - We may amend this Agreement from time to time by giving you written or electronic notice. Notice may be included in your Account statement. The notice may state that there has been a change in this Agreement and that changes have been posted on our web site, or instruct you to call 919.684.6704 to request a copy. Continued use of the Service following notice of amendment constitutes acceptance of any amendments to this Agreement.

Severability - If any provision of this Agreement is determined to be void or invalid, the remainder of this Agreement shall remain in full force and effect.
1Fee will be assessed if your monthly average balance falls below $2,500 in loans or deposits or if Direct Deposit with DUFCU is cancelled for any reason.
2Charge will be collected if we are required to hold or deliver funds in compliance with a levy or garnishment.
3All ATM and POS Debit Fees will be posted at the end of the month.
4Balances above $2500 receive unlimited teller withdrawals, balances above $300 but less than $2500 receive two free teller withdrawals per month and balances below $300 receive no free teller withdrawals.
